  • ​Open to the Public:

    • Contract services and general subscription services cannot interfere with the provision of public transportation. The Integrated Mobility Division (IMD) will work with each grantee to ensure that public transportation services are available.
    • Public transportation services should be offered during normal commute times. It is the responsibility of the transit system to design and operate their service to meet the needs of their population.
    • A public transportation provider must provide shared ride service as a general nature of their service, but not every trip must be a shared ride.
    • Markings on the vehicle should not imply that any organization, agency or governmental entity has exclusive use of the vehicle.
    Deviated Fixed Route:
    • Deviations from the route must accommodate persons with and without disabilities.
    • Deviated routes must be operated with a lift‐equipped vehicle. The vehicle cannot drive past a person waiting at a stop that needs a lift to board unless the vehicle is full.
    • The transit system decides how far from the route they will allow the route vehicle to deviate to pick‐up or drop off a passenger (distance deviated must be consistent with each request).
    • Marketing of a deviated fixed route must clearly describe how to request a pick‐ up or drop‐off that deviates from the route.
    • A deviated fixed route will be considered demand response service and not complementary ADA paratransit service.
    Fixed Route in Rural Areas: All fixed route service shall provide complementary ADA paratransit.
    Prioritization of Services: Any prioritization of services, contract or otherwise, must not discourage the public from using the service.
    Out of State Service: The Federal Motor Carrier Safety Administration (FMCSA) has regulatory responsibility for operators of small passenger carrying vehicles that engage in interstate service. Subrecipients must comply with these regulations as applicable. More information about FMCSA regulations is in Attachment 405‐1.
    Service Area: A 5310 project applicant must prove they are coordinating and providing service within the rural or urbanized area associated with the application. The boundaries for rural areas and urban areas will be determined by the U.S. Census Bureau. NCDOT will use this information to determine funding eligibility for Federal programs that use service area as a determining factor. Connectivity between service providers may be necessary to meet the needs of North Carolina’s citizens.
    Scheduling Software: NCDOT requires every transit system to use some type of scheduling/billing software. The software will assist in reporting data that can be validated by reviewing manifests during site visits. NCDOT’s Technology Policy will guide the system’s eligibility as well as eligibility requirements.
    Data Focused: Performance measurement systems must be in place to ensure transit systems are meeting the metrics defined in their Success Plans and/or as a recipient of Federal and state funds. Data accuracy in reports will be reviewed.

    Passenger Mixing:
    • The exclusive transport of a human service agency's clients with no other passengers on a public transit vehicle cannot be intentional and cannot be a stipulation in any service contracts.
    • Passengers funded by various funding sources and different eligibility criteria may be scheduled to ride together on the same vehicle.
    • A vehicle or route funded specifically for a project can incidentally be scheduled to transport other passengers that do not meet the eligibility criteria of the project.
    Required Policies:
    • Incidental services;
    • Wheelchair transport;
    • Service animals;
    • Attendant service;
    • Cancellations and No Shows;
    • Confidentiality (passengers' private information, employee records);
    • Smoking on vehicles and in transit facilities; and,
    • Significant change in service definition and public notification procedures.​
