The recipient and/or user of the software and electronic files associated with this disclaimer agrees that these electronic files are NOT part of the Contract for the subject project and are provided for the convenience of the recipient and/or user only. The NORTH CAROLINA DEPARTMENT OF TRANSPORTATION and its consultants assume no responsibility for any inconsistencies or discrepancies between these electronic files and the documents that comprise the Contract for the subject project, as defined by the applicable North Carolina Standard Specifications for Roads and Structures.

The NORTH CAROLINA DEPARTMENT OF TRANSPORTATION makes no representation, warranty or guarantee, expressed, implied, or statutory, as to the accuracy, reliability, suitability, functionality, or results derived from any of the subject software and associated electronic files.

Any and all warranties and representations of any kind with regard to the associated software and electronic files are expressly excluded, including the implied warranties of merchantability and fitness for particular use. The recipient and/or user accepts all responsibility and risk associated with the download and use of the associated software and electronic files and further agrees that under no circumstances will the NORTH CAROLINA DEPARTMENT OF TRANSPORTATION or any of its officers, employees or contracted consultants be liable for any consequential, incidental, special or exemplary damages associated with the use or reliance on the subject software and electronic files.

The NORTH CAROLINA DEPARTMENT OF TRANSPORTATION will have no liability or responsibility to the recipient and/or user or any other person or entity with respect to any liability, loss or damage; including, but not limited to, any interruption of service, loss of business or anticipatory profits, or consequential damages, caused or alleged to be caused directly or indirectly by use of the software or electronic files.
