• Local Programs Management Office (LPMO)

    The LPMO is a central office that oversees the creation, delivery, and execution of Municipal and Developer agreements that are requested by NCDOT Business units, Division Offices, or other NCDOT personnel and are connected to the development, construction, and operation of transportation projects.

    The LPMO also provides oversight and guidance to locally developed and -delivered projects that NCDOT reimburses with Federal and/or State funds. The LPMO assists with and provides standards for successful administration and close-out of projects.​​

WHAT IS AN AGREEMENT?

An Agreement is a binding, legal document between two or more parties that details responsibilities, costs of work and financial commitments, project delivery requirements, schedule, and maintenance as appropriate per agreement. Each agreement will have different provisions depending upon the scope of work and responsibilities by each party.


WHY DO WE NEED AN AGREEMENT?

An Agreement must be in place before the Department can reimburse funds or receive funds. An Agreement is also needed if maintenance resposibilities need to be identified.

HOW ARE AGREEMENTS EXECUTED?

NCDOT is now using DocuSign to execute agreements. Entities working with NCDOT do not need a DocuSign account. The Entity will receive a DocuSign email/link and agreement will route to all parties for signature. All parties will receive an electronic copy of the fully executed agreement.

​HOW DO I REQUEST AN AGREEMENT?

For Federal-aid projects that a Municipality is delivering, the Municipality will request agreements through the EBS portal (see Local Projects tab). All other agreements will be requested by the Division or Business Unit (see Division Resources tab).

WHAT IS A LOCALLY-ADMINISTERED PROJECT?

Local Government Agencies, or LGAs, receive federal and state money based on the recommendations of Metreopolitan or Rural Planning Organizations (MPOs and RPOs); through prioritization via the Strategic Transportation Initiative (STI); by applying and receiving Federal grants; or by Legislative directives. Per NC Board of Transportation (BOT) policy, LGAs are generally responsible for developing and delivering the project or implementing a program. Examples of typical local projects include:

  • ​Greenways or Multi-Use Paths, or Sidewalks
  • Intersection Improvements (crosswalks, turn lanes)
  • Bicycle Lanes


WHAT IS NCDOT'S ROLE?​

NCDOT's role is to advise, approve and oversee the proper expenditure of funds by an LGA on an eligible project or program. NCDOT is committed to establishing appropriate oversight to ensure the best use of public funds and compliance with all applicable state and federal regulations.

MUNICIPAL / D​EVELOPER AGREEMENTS

LPMO is responsible for the preparation and execution of Municipal and Developer Agreements, mainly on the Highway Division side of NCDOT. All Agreements must appear on the NC Board of Transportation (BOT) Agenda Item O prior to execution by the Department.  The Divisions and Business Units are responsible for making agreement requests to the LPMO.

1.     HOW DO I REQUEST AN AGREEMENT?​​​


The Municipal Agreement Management System (MAMS) allows Business Units and Divisions to request municipal and developer agreements, provides a workflow to track review and approval of agreement, incorporates DocuSign into the Agreement execution process, and provides a direct workflow to Accounts Receivable for posting funding and setting up “fiscal documents" in SAP, or Accounts Payable to set up purchase orders for reimbursing outside entities.​

    • Do you need access to the Agreements Web Application (the “Burgundy" system)? Send an e-mail to your LPMO Contract Officers.

2. WHAT IS THE BOT AGENDA SCHEDULE?

3.     WHAT ARE THE AGREEMENT TYPES?

A brief summary of Agreement types is below.

    • ACCOUNTS RECEIVABLE – NCDOT is performing work or providing            services with reimbursement by the Other Party to NCDOT.
    • ACCOUNTS PAYABLE – The Other Party to the Agreement is providing work or delivering a project with reimbursement by NCDOT to the Other Party.
    • NO FUNDING - Agreement between NCDOT and the Other Party that             defines responsibilities of each party - no funding is exchanged.


4. ​​​​     HOW ARE AGREEMENTS EXECUTED?

The Department is using DocuSign for execution of Agreements and the DocuSign interface is embedded in the new Agreements Request System in EBS. ​​​LOCALLY-ADMINISTERED PROJECTS

​​​​​Per the NCDOT/FHWA Oversight and Stewardship Agreement, NCDOT has been delegated oversight authority for locally-administered projects. NCDOT's oversight is spread among multiple business units, but Division Offices have a primary role in reviewing, approving, and certifying that Local Projects are administered in accordance with accepted standards and procedures.

DOT GRANTS IN EBS
The DOT Grants tile in EBS allows you to access all locally-administered/federally funded projects and review agreements, documentation, authorized funding, reimbursements, and status. The platform is accessible to both local government agencies (LGAs) who are responsible for submitting documentation for DOT to review. A request for an Agreement in the portal initiates the project delivery process. Division staff providing project management for Locally Administered Projects (LAP) should get access to the EBS Portal for review and approval of project deliverables for project delivery.
