| POLICY: Right of Way (ROW) Funding Authorization is necessary for any ROW Acquisition. ROW Funding Authorization occurs only after the Environmental Documentation and ROW plans have been approved. NCDOT will not participate in any ROW costs that have been incurred before ROW Funding Authorization has been made. |
ROW Funding Authorization is only required when NCDOT is participating in the costs of ROW Activities. Authorized funds may be used towards survey, appraisal, Professional Engineering Firm (PEF) costs, lawyer's fees, and purchase of real property.

Procedure
Requesting ROW Funding Authorization in the EBS Portal:
- The LGA submits the Environmental Documentation, estimated ROW cost, and approved ROW Plans for acquisition, which shows sufficient documentation of property (metes and bounds) to prepare a deed and record it.
- NCDOT submits the funding request to the Federal Highway Administration (FHWA). NCDOT will provide notification when the funding is authorized and expenses may be incurred.
IMPORTANT: Any costs that are incurred related to ROW Acquisition, before ROW funds are authorized, are not eligible for Reimbursement.
