  • Construction Funding Authorization

  • ​​POLICY: Construction funds are used to pay for the direct costs of Construction activities, including Construction Administration (CA) and Construction Engineering and Inspection (CEI). Construction Funding Authorization can only be requested after the Environmental Documentation is approved; the Department has certified the Right of Way (ROW);  the Local Government Agency (LGA) has certified Utilities, and Railroad; the final Plans, Specifications, and Estimates (PS&E) package is approved; and the Contract Proposal is accepted by NCDOT. NCDOT will not reimburse the Construction phase if the LGA advertises the contract prior to construction funds being authorized.

    Construction Funding Authorization is the last phase to be authorized prior to Advertising a construction proposal. The LGA must meet all the deliverables noted previously before construction funding will be authorized.

    IMPORTANT: The LGA cannot advertise for construction contract(s) prior to Construction Funding Authorization (23 CFR 635.112​).

    • Materials testing, construction inspection, and other work directly related to the administration of the construction contract (e.g., processing contractor payment requests, or preparing change orders, a final punch list, or project close-out paperwork).


    Procedure

    Requesting CON Funding Authorization in the EBS Portal​:


    • NCDOT requests construction funds to be authorized from the Federal Highway Administration (FHWA).
    • NCDOT notifies the LGA and provides a notice to proceed with procuring bids once construction funds have been authorized. The LGA may not advertise the construction contract until construction authorization is received (23 CFR 635.112).

    IMPORTANT: If the LGA advertises for bids before construction is authorized, the work will not be eligible for Reimbursement.​
