  • To the extent required by Federal law, regulations, or requirements, the subrecipients will make a good faith effort to include certified DBE participation in all procurements.

    Good Faith Effort: A good faith effort that includes NCDOT certified DBE businesses in all procurements is required with any application. Applicants will submit documentation of good faith efforts that they will exercise to identify and utilize DBE participation on FTA funded projects. A review of procurement records should include documentation (logs of phone calls, solicitation letters and e-mails, logs of follow-up documentation, etc.) that the grantee has made these efforts.
    Predicting DBE Use: With each transit agencies application, applicants will submit a list of NCDOT certified DBE businesses that they plan to include in their procurements during the period of performance of the project on the IMD DBE/MBE/WBE/HUB Anticipated Vendor Awards Form. Each DBE firm listed on the Anticipated Vendor Awards Form will have a Subconsultant Form RS-2 or Subcontractor Form RS-2, as applicable, submitted to IMD DBE Liaison for approval and confirmation of commitment prior to the advertisement for services.
    NCDOT Certification: NCDOT certified DBE businesses are identified online in the Directory of Transportation Firms which can be accessed from the NCDOT homepage or by entering (Link​) in a web browser.
    DBE Reporting: The Subrecipient shall continue to update their DBE commitment(s), award(s) and good faith efforts to utilize DBE participation on the IMD DBE/MBE/WBE/HUB Anticipated Vendor Awards Form on a quarterly basis. 
    DBE Payments: Subrecipients must submit payments made to NCDOT certified DBE businesses monthly on the NCDOT Subrecipient Payment Information Form (Form DBE-IS) as well as on the IMD DBE/MBE/WBE/HUB Vendor Payments Form and acknowledge any purchase made from DBEs in their reimbursement claims in EBS. Payments to locally recognized DBE businesses that have not been certified by NCDOT do not count as DBE purchases nor participation in reaching any minority participation goals.
